Public institution (VšĮ) taxes

Non-profit status does not automatically exempt a Lithuanian public institution (VšĮ) from tax. Taxable profit from commercial activities is subject to 17% corporate income tax or, if the requirements are met, 7% or 0%. Properly used earmarked financing and donations must be distinguished from commercial revenue.

A VšĮ may reduce taxable profit by amounts directly allocated to public-interest activities during the current tax period or planned for use during the following two periods. Supporting evidence is required; misuse or failure to use funds as required may lead to a tax recalculation. Corporate income tax is declared on form PLN204N. [S6]

No dividends may be paid to stakeholders. A stakeholder may receive remuneration for genuine work or another lawful transaction, but stakeholder status itself is not a basis for payment. Transactions are assessed by their substance. A VšĮ should not be chosen merely to extract business profits for private use. The applicable legal framework must be reviewed for each case.

VAT treatment depends on the services provided. Exemptions for education or healthcare apply only where specific statutory conditions are satisfied; not all VšĮ services are VAT-exempt.
